The Bar Council is a statutory body established under the Legal Profession Act 1976 (LPA) “for the proper management of the affairs of the Malaysian Bar and for the proper performance of its functions”. It is responsible for all matters pertaining to the admission and regulation of advocates and solicitors in Peninsular Malaysia.

The Bar Council issued its press release entitled “Clarification regarding Rohaizat Othman” on 18 August 2009 in response to media inquiries on the matter. We regret the statement made by the Deputy Prime Minister, Tan Sri Muhyiddin Yassin, implying that the Bar Council had an ulterior motive in raising this issue.

The decision to strike Rohaizat Othman off the Roll of Advocates and Solicitors was made by the Disciplinary Board, an independent body established under Section 93 of the LPA. Members of the Disciplinary Board, which is currently chaired by Tan Sri Khalid Ahmad bin Sulaiman, are appointed by the Chief Judge of Malaya after consultation with the Bar Council.

The Bar Council is authorised to speak on behalf of the Disciplinary Board on matters relating to disciplinary proceedings involving advocates and solicitors.

Press Release: Clarification regarding Rohaizat Othman

In response to inquiries from the media, we wish to clarify Rohaizat Othman's status as an advocate and solicitor.

The Advocates and Solicitors Disciplinary Board struck Rohaizat Othman off the Roll of Advocates and Solicitors on 7 March 2008 after he was found guilty of misconduct. The Disciplinary Board's decision arose from an investigation into the complaint lodged against Rohaizat Othman by the purchaser of a piece of real property. According to the complaint, Rohaizat Othman failed to refund almost RM 161,000 to the complainant after the transaction was aborted.

Rohaizat Othman appealed against the decision of the Disciplinary Board to the High Court, and the appeal was dismissed on 12 August 2009. He is therefore legally disqualified from practising as an advocate and solicitor.

The finding of misconduct is personal to Rohaizat Othman, as the Disciplinary Board would not hold a lawyer liable for the actions of his/her law partner(s).

Mesyuarat Jawatankuasa Peguam Kelantan pada 16/8/2009 yang lalu telah bersetuju untuk membina laman webnya sendiri. Dan sebagai permulaannya adalah dengan cara 'menumpang' di blogspot.com.

Dengan harapan untuk menjadi wadah perhubungan antara ahli peguam Kelantan yang telah mencecah seramai 340 orang maka dengan ini dipersembahkan http:kelantanbar.blogspot.com.
